Hernandez vs. Texas is a landmark, but often overlooked, Supreme Court case. It is the first case brought by Mexican-American lawyers before the U.S. Supreme Court and was decided the week before Brown v. Board of Education. The Hernandez case was the first in which Mexican-Americans were recognized as constituting a distinct group entitled to recognition and protection under the Equal Protection Clause of the 14th Amendment. The case overturned an all-white-jury murder conviction of Pete Hernandez and held that the prejudice and discrimination against Mexican Americans in Texas were so pervasive that the conviction had not been determined by a jury of his peers. The Hernandez case had been tried in Edna, Texas, a "sundown town" that was deemed too dangerous for Mexican Americans to stay overnight.
Olivas will also discuss the immigration debate in the Charles and Linda Wilson Dialogue on Domestic Issues: "Illegal Immigrants: Path to Citizenship?" at 7 p.m. March 25 in the E.N. Thompson Forum on World Issues at the Lied Center for Performing Arts, 301 N. 12th St.
