Environmentalist Lawyer Vows To Force NYSDEC To "Quit Concealing", "Cough-Up Toxic Emissions Information" Of Greenwashing Tenant Chemical Company Anellotech On Pfizer Pearl River "Campus"

Tormey III, Esq., Attorney for advocacy group "Anellotech Means Cancer", has filed an Article 78 Freedom Of Information litigation in New York State Supreme Court, Ulster County in Kingston against the New York State Department Of Environmental Conservation. Aside from NYSDEC, at its "South Putt Corners Road" New Paltz office, also named as Respondents in the suit are DEC's Commissioner Joe Martens, Attorney Deborah Whipple Christian, and Records Officer Ruth L. Earl.
Said Petitioner John J. Tormey III, Esq.:
"It is time that the New York State Department Of Environmental Conservation tells the people of Rockland County the truth and comply with that agency's obligations of transparency under the Freedom Of Information Law ( FOIL ). It is an outrage that DEC calls the following "only minimal redactions" from its FOIL "production" of toxic Anellotech's e-mail:
"Because of the lethargy and failures of DEC and multiple other state officials to date, Pearl River and Nanuet residents are about to suffer construction of a 99-foot high smokestack directly in their midst. Through this smokestack Anellotech by its own admission will extrude leukemia-causing benzene, toluene, xylenes, c5+ hydrocarbons ( typically found in gasoline ), methane, carbon dioxide, carbon monoxide, ethylene, propylene, and butylenes. These chemicals are carcinogenic, mutagenic, and toxic. They will kill our property values. They will kill us. We're not going to take that.
"The FOIL litigation in Kingston will force DEC to quit concealing and instead cough-up the remainder of Anellotech's poisonous emissions information and other data. The matter will be appealed to the highest possible court as may be necessary to achieve that successful and productive result".
Anellotech Means Cancer vows that other New York State public officials who have defaulted on FOIL responses will be met with similar proceedings.
